This update involves:
- LEPF’S Lawsuit Against ALPA
On Friday, January 16th, we received an order from the court granting ALPA’s motion to dismiss the lawsuit on the grounds that the six-month statute of limitations for claims against a union for breach of its duty of fair representation (DFR) had expired. The court essentially ruled that, because ALPA adopted a resolution on May 19, 2022, opposing any attempts to increase the retirement age for professional airline pilots beyond the current age 65 limit, the DFR claims would have had to have been filed within six months of that date to be timely. The order was not a final disposition of the case and LEPF and its counsel immediately undertook an analysis of the order, its implications, and the legal strategy going forward.
On Wednesday, January 21st, we convened our Board of Directors to discuss our options with our legal counsel. Shortly after the conclusion of our BOD meeting, we received notice that the court entered final judgment in favor of ALPA.
Facts:
- The lawsuit is between LEPF and ALPA.
- We have a bill in the House of Representatives and have been assured by the Senator sponsoring the Senate bill that it will be introduced this month of January. LEPF is on the Senator’s timeline, not our own, and we are working on that commitment every single day.
- LEPF remains fully engaged and focused on eliminating/raising the mandatory airline pilot retirement age.
- We are 100% focused on our mission every day, as our NOTAMs have always explained.
- LEPF has always been honest, truthful, responsible, disciplined, strategic, measured, accurate, and mature in its communications, actions, and lobby efforts, and has never disparaged anyone or any organization.
- LEPF is willing to work with any mature and responsible pilot(s) that are capable of informing our supporters with accurate information and be respectful of others. We feel certain that you will agree that like Experience Matters, Wisdom Matters, as well.
One final comment. When we have repeatedly informed you that the bill will be introduced in the month of January, that is exactly what the senator introducing the bill told LEPF. We gain nothing by not being truthful, and for anyone or any organization to state otherwise is simply a sign of desperation from an organization that has lost its compass.

The burden of proof should be on the agencies that restrict the pilot license privileges at a certain age, to justify why they do so, because EXPERIENCE MATTERS!
